A Virginia Notary Public, including a Mobile Notary, is authorized to perform the following professional acts under Virginia Code § 47.1-12:

Acknowledgments

Verifying that the signer personally appeared, was properly identified, and voluntarily signed the document.

Example: real estate deeds, powers of attorney, business contracts.

Oaths and Affirmations

Administering a sworn or affirmed statement of truth.

Example: affidavits, sworn testimony, depositions.

Jurat (Verification on Oath or Affirmation)

Certifying that the signer personally appeared, was identified, took an oath/affirmation, and signed in the notary’s presence.

Example: sworn written statements, legal filings.

Affidavits & Depositions

Taking written or oral statements under oath and certifying them as true.

Certifying Copies

Confirming that a copy of a document is a true and accurate reproduction of the original (except vital records such as birth, marriage, or death certificates, which must come from the issuing office).

Electronic Notarization (e-Notary)

Performing notarizations electronically, with the same authority as traditional notarization.

Remote Online Notarization (RON)

Using secure audio-visual technology to notarize documents when the signer is not physically present. Virginia was the first state to authorize RON (2011).

A notary must verify identity of all signers (via government-issued ID or credible witnesses).
All notarial acts must be recorded accurately in compliance with Virginia law.
A notary cannot give legal advice or certify vital records.
