Acknowledgments

A notary certifies that the person appearing before them has signed a document voluntarily, and that the person is who they claim to be.

Administering Oaths and Affirmations

A notary can administer an oath (sworn promise) or affirmation (non-religious promise) to an individual.

Example: Affidavits, sworn testimony, depositions.

Certifying Affidavits

A notary may take affidavits or depositions and certify them under oath or affirmation.

Certifying Copies

A notary can certify that a copy of a document is a true and accurate reproduction of the original (with exceptions such as vital records and court-issued documents that must come from the issuing authority).

Electronic Notarization (e-Notary)

Virginia allows electronic notarization, including remote online notarization (RON), where the signer and notary interact through audio-visual technology. Virginia was the first state to authorize RON (2011).

Verifications on Oath or Affirmation (Jurat)

A notary certifies that the signer personally appeared, was identified, swore/affirmed the truthfulness of the document, and signed in the notary’s presence.

A Virginia notary does not have the authority to certify vital records (like birth or marriage certificates) or issue legal advice.
